TERMS AND CONDITIONS OF SALE

1. INTRODUCTION

1.1 The general terms and conditions of sale and use transcribed herein (hereinafter referred to as the "General Terms and Conditions") apply worldwide. They are governed by the Consumer Code (Chapter I, Title III of Legislative Decree No. 206/2005, Articles 45 et seq.) and by the rules on electronic commerce (Legislative Decree No. 70/2003, as amended) and apply exclusively to distance selling of the Items shown on jcpuniverse.com via the Internet

For the purposes of this document hereinafter referred to as "ONIRO"

1.3 Definitions

The term "Contract" means the contract of sale of the Seller's tangible movable property, stipulated between the latter and the Customer within the scope of a distance selling system through electronic instruments, organised by the Seller.

The term "Customer" means the consumer who is a natural person who makes the purchase, referred to in this contract, for purposes unrelated to any commercial or professional service performed.

The term "Seller" means ONIRO.

1.4 This section, which is valid for legal purposes, constitutes the agreement between the user who browses the Site, also referred to as the "Customer" and ONIRO. By browsing our Site and taking advantage of its e-commerce services, the Customer is required to accept the General Conditions set out herein.

2. OBJECT OF THIS CONTRACT

2.1 With this contract, respectively, the Seller sells and the Customer buys at a distance by electronic means the tangible movable goods indicated and offered for sale on the site www.jcpuniverse.com.

2.2 The items referred to in the previous point are illustrated on the web page: www.jcpuniverse.com.

3. MANNER IN WHICH THE CONTRACT IS STIPULATED

3.1 The contract between the Seller and the Customer is concluded exclusively via the Internet through the Customer's visit of the site www.jcpuniverse.com, where, by following the procedures indicated, the Customer manages to formalise the proposal for the purchase of goods.

3.2 In order to be able to purchase Items on the Site it is necessary to follow the registration procedure.

After registration you do not have to re-enter your personal information every time you make another purchase, monitor shipments, make complaints or return goods.

3.3 In order to protect the security and quality of our e-commerce platform, we reserve the right not to accept more than one registration or to delete an "account" at any time if this may constitute an illegal act.

3.4 Failure to register and accept the General Conditions will make it impossible to make purchases.

3.5 To register and make purchases, please fill out the registration form by entering the required details. The user must login with a password, which can be changed at any time, even after registration. Registration is confirmed by email sent to the address provided by the user. The username/email and password are the "Registration Credentials" for login to the platform.

3.6 Your Registration Credentials are personal and may not be given to third parties and may be changed by you at any time by login to the Site in the section MY JCP - My Account - Change password. The Customer is required to notify ONIRO in case of misuse, theft and/or loss of the Registration Credentials.

3.7 The Customer is required to enter his/her details accurately and truthfully and is responsible for entering false or misleading information, which is punishable by law. The Customer agrees to hold ONIRO harmless by any indemnity obligations or sanctions arising from and/or in any way related to breaking registration rules. The Customer is responsible for any login to his/her profile carried out by using his/her Registration Credentials and is directly liable for any damage or harm caused to the platform and carried out through his/her Registration Credentials.

3.8 All transactions carried out using the "Registration Credentials" are considered to have been made by the Customer to whom the "Registration Credentials" were assigned.

3.9 Registration must be done by using your own active email account. Profiles that have been registered with another person's email address or a temporarily assigned email, already registered or not validated may be unable to successfully complete the registration process or, if completed, may be deleted without prior notice. You may change your email address at any time by logging on to the Site in the section MY JCP - My Account - Account Information - Change Email.

3.10 You can always delete your account by making a request via email or through the customer care form
